Foreign worker program rules get tougher next week

OTTAWA, Ont. -- Changes to the Temporary Foreign Worker Program protect workers and limit them to four years of work, says the Canadian Trucking Human Resources Council.

The changes, which are related Immigration and Refugee Protection Regulations, and come into force on April 1, will address several issues, such as genuineness of job offers, compliance reviews, and duration of employment.

Employers will be assessed based on their ability to meet the terms of a job offer and whether it is actively engaged in the province in which a Labour Market Opinion (LMO) is submitted.

Reviews will also determine that employers and third-party agents acting on their behalf have a history of complying with employment and recruitment laws.

As well, regulators will ensure that wages and working conditions have, over the two years preceding an LMO application, been "substantially the same" as the original job offers to temporary foreign workers.

Rates will also have to be inline with Canadian "standards."

Employers will be barred from the program for two years (and names will be made public) if there are any discrepancies, although fleets will have the opportunity to justify any differences.

Employers will also be are responsible for ensuring temporary workers who do not become permanent residents don't work more that the four-year limit.

There's more: Employers need to sign a contract with employees to outline wages, duties, and conditions related to the transportation, accommodation, health and occupational safety of the foreign workers.

They also must cover recruiting costs; consult with the local union if the position is covered under a collective agreement; help find suitable and affordable accommodations; pay the worker’s full airfare to and from their home country; provide medical coverage until the worker is eligible for provincial health insurance; and register workers through provincial workers compensation or workplace safety insurance plan.

Fleets that want to change a Temporary Foreign Worker’s terms of employment should contact HRSDC/Service Canada.

I'm really not interested Gord, though I live in your neck of the woods. I dare you to look back at some of your past comments and try to imagine what kind of impression you're giving people about modern truckers. It is sad and uncomfortable for us true professionals who read this site to stay in touch with our industry and figure out how to overcome the adversity built into our job. Rise above it, man! Figure out how to beat the system. There are plenty of profitable truckers out there who love their jobs. I am one of them. You may be friendly, but you are not Mr. Sunshine. You, sir, are a defeatist. I'm sorry to say it. In the years that I have been reading this site I have found numerous ways to improve my tiny operation and squeeze out of it a very respectable living. You could too if you tried.

Hi Anonymous, Give me a call I will meet you at the Husky. 604-792-6720 I think I am quite friendly but yes I have to admit I am not one that a Trucking company or shipper can BS in going to work at sucker rates. You see 80 0r 75% of nothing is nothing and when you run home empty or Run 500 miles to pick up a back haul that was farther a way then you were when you unloaded and the back haul pays $1.00 a mile you just wasted a whole trip cause you never made any money. Most Trucking companies pay less for owner operators than it costs for a Truck and a Driver. So how are You the owner operator going to make decent wages plus get a return on your investment while obeying all Government regulations? Yours truly, Gordon Currie P.S. There is no driver shortage!! The carrier executives just want to line their pockets on more cheaper labour, as the government pays part of these foriegn driver wages!! Get the carrier executives out on the road driving see how they like making lower and lower wages every year even the best carriers are bottom feeders just spin it a different way!!! The trucking magazine publishers need to get the facts straight, go undercover as a driver and you will see how we are treated instead of the smoking mirror tour!!

THERE SHOULD NOT BE ANY FOREIGN DRIVERS WORKING IN CANADA cause I have not been able to get a decent paying Job for over three years. I am still unemployed and sending out resumes to advertised jobs with no response back in most even though I am more than qualified driver and equipment operator for any of the jobs I have seen. I have 38 years experience since I started my first Trucking business and sold my 2002 Peterbilt and 2001 53'Reefer Trailer in 2010 due to low pay Freight and one way loads [no return freight]. I have turned down a few jobs due to them being low pay, poor Truck which will cost me money per mile or comfort or part time.
