Judicial panel rolls 14 lawsuits against Navistar into one

LISLE, IL – A five-judge panel has consolidated 14 lawsuits against alleged defects of Navistar’s EGR-only engines.

In October, Navistar International had requested that all lawsuits pertaining to the performance of its EGR-only engines be rolled into one. There have been 15 suits filed in eight different federal districts, and 11 others in state courts. Navistar said it had also received notices of intent to sue from 21 other parties. Litigation has been building since summer. Claimants say they’ve had repeated and excessive breakdowns on their trucks powered by the MaxxForce engines, including components such as the EGR cooler, EGR valve, turbochargers, and clogged fuel injectors.

The judges’ ruling pertained only to the 15 federal cases – leaving one of them out because it had reached “an advanced state.”

Proceedings in the bundled suit have been transferred to the Northern District of Illinois.

The ruling was made Dec. 17 by a five-judge panel on multidistrict litigation.
