New Border Regs Edging Closer to Truck Carriers

OTTAWA, ON — The Canada Border Services Agency’s (CBSA) eManifest requirements under the Advanced Commercial Information (ACI) program was pre-published last weekend in the Canada Gazette, Part I, according to the Canadian Trucking Alliance (CTA).

“Now that the regulations have been pre-published in the Gazette Part I, public and industry stakeholders will have 30 days to submit comments on the proposed regulation,” the CTA explains. “CBSA will then respond to all comments it receives and once any necessary adjustments are made, the regulations will be published in the Canada Gazette Part II. CBSA will then make a subsequent announcement that eManifest will soon be mandatory and highway carriers will have 45 days advance notice of the mandatory compliance date.”

What this means is that the requirements for carriers to give shipment information to CBSA in advance is closer to being put into practice. Voluntary submission began in October 2012 and CBSA reports that more than 10,600 highway carriers are currently using eManifest, representing more than 95 percent of the cross-border highway volumes in 2013.

The ACI initiative (also known as eManifest) is about giving CBSA officers electronic pre-arrival cargo and transport information so that they can identify health, safety and security threats related to commercial goods before the goods arrive in Canada.

Once the system is mandated, there’ll be six-month period where zero-rated Administrative Monetary Penalty System AMPS penalties will be applied for non-compliance. Following that, penalties will be assessed to non-complying carriers.
