Ontario company fined $100,000 for dock death

BRAMPTON, ON – An Ontario party décor business has been fined $100,000 after a temporary worker was hit by a reversing truck at a loading dock.

Dream Party Décor, which sets up decorations and amenities at rental halls, was using a temporary worker to help unload the truck at a loading dock at 1415 Bonhill Road in Brampton, Ontario on March 22, 2014.

The truck, which did not have a clear view or signal person, shifted into reverse and pinned the worker to the loading dock. The worker suffered fatal injuries.

Dream Party Decor was convicted of failing to comply with section 56 of the Industrial Establishments Regulation, which requires a signaller in cases when a vehicle does not have a clear view when reversing.

The fine was imposed by Justice of the Peace V. Albert Chang Alloy in Brampton court on July 5, 2016. The court also imposed a 25% victim surcharge which is paid into a government fund to help crime victims.
